1.1. Type-X Finance takes steps to protect your privacy. We, in our capacity as Data Controller, have created this Privacy Policy to inform you about why we collect and how we process your Personal Data.

1.3. The legal basis for which Type-X Finance acts as Data Controller are as follows:

1.3.1. GDPR Article 6(1)(b) - processing of your Personal Data is necessary for the performance of our contract with you, the User of our Website and Services;

1.3.2. GDPR Article 6(1)(c) - processing of your Personal Data is necessary for compliance with a legal obligation;

а. ensuring Type-X Finance's systems are secure and for the purposes of performance and error monitoring and incident response;

2.1. An outline of the Personal Data that we require, accept, collect and process, when we collect it, how we use it and why we use it (for example the lawful reason of processing) is listed underneath:

- Email
- Telephone number
- The country of residence of the User
- For natural person:
1.government-issued ID (passport, driver's license, national identity card, tax ID number, passport number, driver's license details, national identity card details); 2. proof of address; 3. photos and videos, if you decide to provide them to us; 4. inquiries and chat history with our Customer Support Team; 5. other Personal data that may be required by our AML and KYC Policy compliance obligations.
- For legal entities:
1. company and tax identification number; 2. copy of the register of shareholders and their identification document; 3. copy of Certified Memorandum of Association & Articles of Association; 4. copy of the Certificate of Incorporation; 5. confirmation of registered address (not older than 3 months); 6. confirmation of correspondence address (in case the registration address and correspondence address are not the same); 7. proof of residential address of the UBO.
- Device and website usage data:
1. IP addresses; 2. language preferences and other device identifiers; 3. information relating to User’s access to the Website, such as device characteristics, date and time; 4. logins of User’s actions with account (successful log in, unsuccessful log in, changing of the types of security, password recovery)
- Account activity:
1. trade activity; 2. transaction history; 3. orders terms; 4. orders created; 5. account status and notifications; 6. default currency, default language, time zone.
- Digital wallet information:
1. private and public keys; 2. wallet balance; 3. transactions received/sent; 4. the information about connected cards.
- User’s Telegram activity:
1. chat messages with Type-X Finance’s Customer Support (which may contain your financial information, if you decide to provide it to us); 2. chat attachments which may include screenshots, photos, videos etc.

2.2. We also may use Personal Data:

2.2.1. to tailor content, recommendations, and advertisements we and third parties display to you, both on the Website and elsewhere online;

2.2.2. for internal business purposes, such as to improve our Website and Services;

2.2.3. to comply with our policies and obligations, including, but not limited to, disclosures and responses in response to any requests from law enforcement authorities and/or regulators in accordance with any applicable law, rule, regulation, judicial or governmental order.

2.3. We protect the data obtained from Third Parties according to the practices described in this Policy and we also apply additional restrictions imposed by the source of data.

4.3. For behaviour statistics and business intelligence we may use the service by Google LLC (“Google Analytics”), a company located in the United States or similar services. Data that we may provide to Google Analytics or similar services may include your IP address and that data is used by Google Analytics or similar services to generate information about your usage of our Service.

4.4. For tracking server errors, we use an internal self-hosted monitoring system accumulating stacktraces, logs and metrics.

4.5. For processing notification information, we use chatbots and e-mail notification.

4.6. We may share your Personal Data with the following Third Parties:

4.6.1. external services or authorities when such disclosure is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests and/or the vital interests of a Third Party;

4.6.2. other Third Parties subject to your consent.

4.7. When we disclose your Personal Data to a Third Party, we take all reasonable steps to ensure that those Third Parties are bound by confidentiality and privacy obligations with respect to the protection of your Personal Data. 5.1. Type-X Finance will retain your Personal information for as long as we deem it necessary to provide our Services to you, to comply with applicable laws (including those regarding document retention), resolve disputes with any parties and otherwise as necessary to allow us to conduct our business.

5.2. Your data will be stored within the European Economic Area (“the EEA”) (The EEA consists of all EU member states, plus Norway, Iceland and Liechtenstein) when it is legitimate and applicable.

5.3. The information we receive from you can be transferred and stored outside the European Economic Area (EEA) when it is the requirement of the law of some states. The information about you can be processed by our employees or employees of service providers outside the EEA.

5.4. When storing or otherwise processing information by such Third Parties outside the EEA, We guarantee that we will notify such Third Parties of our obligations under this Privacy Policy and will enter with them into relations that will impose obligations for them regarding your Personal Data, provided that they at least have level of protection as specified in this Privacy Policy. 5.7. We may retain your Personal Data where such retention is necessary for compliance with a legal obligation to which we are subject to, or in order to protect your vital interests or the vital interests of another natural person in accordance with GDPR Article 6(1)(c).
6.1. Data security is of great importance to us, and to protect your Personal Data we have put in place suitable physical, electronic and managerial procedures to safeguard and secure data collected through our Websites. Steps we take to secure and protect your data include:

6.1.1. the pseudonymisation and TLS 1.2 encryption of Personal Data;

6.1.2. 2FA;

6.1.3. the access control;

6.2. Notwithstanding the security measures that we take, it is important to remember that the transmission of data via the Internet may not be completely secure and that you are advised to take suitable precautions when transmitting to us data via the Internet. Although we will do our best to protect your Personal Data, we cannot guarantee the security of your data transmitted to our site, and any transmission is at your own risk. 6.3. Type-X Finance cannot ensure or warrant the absolute security of any information and Personal Data the User transfers to Type-X Finance, cannot guarantee that Personal Data of Users may not be accessed, disclosed, altered or destroyed. In case of illegal disclosure of Personal Data of Users occurs Type-X Finance will notify Users and third persons whose rights are freedoms may be violated immediately. At the same time Type-X Finance will take all reasonable and commercially feasible efforts and measures to protect those persons and their Personal Data from negative consequences of such disclosing.

The changes take effect in 3 (three) days after the moment the new version of corresponding documents is published on the Website. If the User does not accept a new edition of the Privacy Policy, he/she must stop using the Website.
